employee with back issue

Employee received work restrictions but does not follow them. These restrictions are "heavy duty permanent restrictions". Also she cannot sit for more than one hour. She has to walk, stretch, etc for comfort. She doesn't appear to follow these. I don't think I should have to babysit her to make sure she complies. Any suggestions?

  • In the past I have disciplined employees for not following work restrictions (exceeding them, that is). The potential for aggravating the injury and hindering full recovery is just too great not to "babysit" the employee, if necessary. My experience is that if they receive a couple of days off without pay or a negative memo to their personnel file, they often get with the program.

    I also make sure the claims adjuster for that employee's injury is advised of the circumstances. Often, the work comp insurer can exert some influence on the individual to make them comply with restrictions.

    Many states have provisions in their W/comp statutes that address employees who
    "fail to cooperate with medical treatment", etc... and offer remedies to stop TTD payments or future med expenses. You'll have to check 2/c what provisions are avail in KS, but I suspect you have something. Filing a motion with your state agency will likely get the employee's attention. Depending on your insur carrier or TPA, they s/b able to guide you through this process.
