NCCI

What recourse do we have with NCCI to get our experience mod lowered?? The story is, 4 years ago we had a large loss and NCCI returned us a 150% Experience Modification. Perfectly legitament given the loss. During the next 3 years, two AAA rated carriers we used declared Bankruptcy. Consequently they did not update our loss runs to NCCI. Our losses during those three years were less than $500 per year. NCCI will not return phone calls to our Agent or to us. Nor do they answer letters sent to them. We should be paying around 30K per year for coverage but we, of course are paying 45K due to the Mod.xx( Thanks for the responses in advance.

• We have had problems with the accuracy of our experience mod also. Your agent should be able to deal with this for you. If they are not successful, I would start shopping for a new agent.

In the meantime, there are companies who will audit your past work comp records and try to recover past losses, as well as get your current mod to be set accurately. One place that does this is www.synergeticsolutions.com

I don't have personal experience with this group, I only know that they exist. Perhaps someone else on the forum can give you more details on their services.
• We had a similar incident with our EMR. I used Advanced Insurance Management (AIM) out of Riverside, Illinois. Ed Priz, AIM's president, was very helpful and instrumental in getting our mod recalculated. His phone number is 708-442-6010. Hope this helps!
• I agree that your agent should be taking care of this for you. (This is what they get the big bucks for.) Hopefully you and your agent are examining this each year as soon as it is received so that it is "cleaned up" as soon as possible and as you go along. This way even though your carriers are no longer in business the records would hopefully be correct.
If your rating is wrong, I would also think that if you had letters your wrote to NCCI along with supporting documents to show the corrections, you should be able to attach these to the bids that your agent sends out to show that the rating isn't correct.
(I am surprised that you are having this problem with NCCI. We never have when we have to get corrections made and I've been doing this for about 20 years.)
