Asthma - Allergies

Have a 55 yr old factory employee who is responsible for outside storage of raw & finished goods. He has several past instances of work-related injuries resulting in allergic reactions (bee sting, nearness to weed cutting, i.e. airborne allergens). He spends most of his day either outside or in storage areas with shipping docks. He has a history of "early" filing of petitions with Industrial Commissioner.

He has recently had a short term disability involving bronchial asthma which he says was triggered by seasonal allergies. He has missed a day each week of the last 2 weeks since his return. His most recent excuse listed "COPD" so I see more problems coming. However, I am still concerned he will claim it is work-related because his work causes him to be exposed to these allergens. He was a heavy smoker all his life, until quite recently.

At this time I see it related to his recent STD & am advising him of possible eligibility for intermittant FMLA.

Am I on the right track to keep this out of a work-comp situation?
