FMLA and the Grilfriend

One of our employees girlfriend was in a very bad accident last month. He is telling us that she might loose her leg after all. He took some time off that we charged against his vacation and personal time (for entire days not coming to the office). FMLA is very specific about family members. But also mention common-law marriage. As I understand she is a long time girlfriend/live-in. I am not really sure. Do you know what is the law in AZ? I don't want to open the FMLA girlfriend box but I also want to be fair and give him some options.
He missed 2 more days last week. When HR asked him to turn in a personal time off request, he really didn't want to saying is because of his girlfriend.
Note: We had problems with this employee in the past and his attendance. He is a salary employee.
