FMLA AND ANNIVERSARY DATE

Forgive me if this have been discuused but I have rec'd conflicting info. My question is do you move anniverary date back the number of weeks out on fmla or is it protected under fmla and remains the same as if they were not gone. I thought you would have most likely need to move review dates as you could not rate performance for time not there but ann. date would stay the same. Help please would be greatly appreciated.

  • We do not change the anniversary date. If you have an employee out on FMLA and it's time for a bonus, for example, that employee is considered based on performance during the time he/she worked and is eligible for a bonus as though the employee hadn't been gone. FMLA doesn't dictate anything about anniversary dates that I can recall. Someone else chime in - I wouldn't change it myself.

    All of my FMLA's have been pretty cut and dry. They go out and come back in 12 weeks or they don't and are terminated.
