FMLA Unemployment Insurance

We followed the FMLA reg's to a T. This ee exhausted all their FMLA leave, was still not
able to return to work - so we had to terminate him. He filed unemployment, he deserves it. But the notice of determination states claim will be charged against our firm's account. Is this right? We did EVERYTHING right - should we be charged? I am going to appeal, but would like to hear what others have to say. Thanks!
