Maternity Leave Sick Pay

After being on a maternity leave for 6 weeks, and they continue to stay out for the next 6 weeks, can the employee contiune to receive sick pay or do they have to use vacation pay? Also, is that decided by the company or is their a law out there for this in IL?

  • That would be determined by company policy, or previous practice of the company if you do not have a policy.
  • I am not sure what you are asking about. Is your company subject to the FMLA or are you asking about some Illinois law regarding maternity leave?

    If it is the Illinois law, I do not know the answer. If it is FML, then your company policy will determine how you handle pay for EEs that are on FML. Our policy requires all leave banks be paid out during FML. We start with the sick leave bank, then work our way through well time, birthday and then vacation time within the FML guidelines.
