Failure to supply Certification of Health Care Provider

I have an ee who we had to call an ambulance on 2 wks ago, Wednesday 4/21. EE missed Thursday 4/22, Friday 4/23, Monday 4/26, Tuesday 4/27, Wednesday 4/28 and Thursday 4/29, came back to work on Friday 4/30 with a release date of Thursday 4/29. We did a write up on her for not coming in on her release date. The new problem is that she has not turned in paperwork from her doctor stating that she had a serious health condition. She says he has the paperwork, but just hasn't completed it. We are giving her until 5/10 to get that turned in. What if she fails to turn it in?

There is one write up in her file for not showing up or calling in on her release date and in January she had a verbal warning about no call and no show.

  • I would remind her that it is her responsibility to get the certificate from her doctor by the due date or face possible disciplinary measures. You may also (depending on how much you want to keep this ee) call the doctor's office and ask if they do indeed have the form and let them know how important it is to this ee's job.
  • Forget the earlier writeup. It is totally irrelevant. Utilizing that add-on will only buy you grief from an FMLA/EEOC investigator. Mail the employee a certified letter or have her sign personally for receipt of one in your office. The letter should state, "Our office (gave or mailed) you FMLA paperwork on (date). As of this date, we have not received your request for FMLA leave or the medical certification that is required. A portion of the paperwork you were given on (date) was to have been presented to your physician and returned to this office. This is to inform you that in order for us to consider the approval of your absence from work from (date to date), we must receive both your request and the medical certification no later than (10 days from now) or your employment with ABC will be terminated."
