Hello all. I am looking for assistance with drafting a leave policy. Currently, I work for a large public sector employer, but one of my bosses needs a leave policy for his side business. His company only has a total of ten employees, so he doesn't have to comply with FMLA. I am curious if it is possible to draft a leave policy for this small, private sector company which requires that employees burn their vacation and sick leave while out on workers' comp. or other disability leave. Since I am not in the private sector, I have no clue what is possible. Does anyone have a sample leave policy which I could review?

  • I do know that most, if not all, disability and comp carriers will not pay benefits if the employee is otherwise being paid and the notion that you are considering would have that effect. Your individual state law would dictate on the comp piece since each state has its own comp regulations with no national oversight.
