Common Law marriages

In that the state of PA recognizes retroactive common law marriages is it right to assume that they would qualify for a FMLA event?

Does the employer have to recognize these marriages for Bereavement leave or any other Employer benefit?

What is appropriate to ask for to verify the marriage and when?

Any help is appreciated.

  • PA reversed Common Law marriage this summer so these relationships are no longer "legal" in the state of PA...

    so the short answer is that you are not required to provide any employment related benefits.

    We request proof of marriage (court document) upon hire or if already employed within 30 days of the marriage. This is necessary to provide health insurance, FMLA leave, and other benefits.
