If someone falls and hurts their leg?(NOT work related) unable to walk, is that considered to be a serious health condition?

What if some falls and hurts their leg(NOT work related) and it requires surgery? is there any difference?

We have a lady who was at home fell and broke her leg...I think she had to have surgery and I am trying to determine if this person should be on FMLA - for a Serious Health condition? x:-/

Provided your employee has satisfied the hours/service requirement for FMLA, she would be eligible. A "serious health condition" could be either of the two examples you've given (your employee will be incapacitated and under the treatment/supervision of a health care provider). Her provider will give you the medical certification required.
