fmla and new father

I have a soon to be father that want to take time off to when his baby is born. My interpretation of the FMLA is that he can do that, using his sick time in the process. Is that correct?

  • He can take up to 12 weeks of time to bond with his baby and take care of the mother of his child while she is medically disabled. How you pay or don't pay him is up to your organizational policies. We run them at the same time and if they are out of sick time, they can use personal and vacation then go into an upaid status, but they still only get 12 weeks total.

  • We allow 40 hours of Personal Leave that will come out of their sick leave balance. After that, they can take vacation leave or leave without pay up to 12 weeks while they are on FMLA. Unless the mother is an employee as well?
