FMLA and mother-inlaw

I have an employee whose mother-inlaw lives with them for 6 months out of the year. The mother-inlaw at present is living with the employee and her husband the mother-inlaw is going to have surgery and will need care afterwards. My question is this can I give FMLA leave to the employee who is the daughter-inlaw. I know that FMLA says you can have leave to care for a biological parent.

  • Federal guidelines do not allow coverage for "in-laws". You may have state guidelines (we have them in WI) that DO allow for coverage for "in-laws". You always have the option of going "above and beyond" what the law requires but keep in mind you are setting a precedent to all other employees.
