Returning from maternity leave

We have an employee who is returning from leave. Her position prior to leave was A/P clerk. Since she has been gone we have come across numerous errors and vendor invoices not posted and put in a drawer. Upon her return we would like to put her in another dept. as A/R clerk. The positions are of the same caliber but, she will have more supervision and a new work station. Her benefits and wage will remain the same. Her job tasks are reverse of what she was doing previously since it is now our invoices and customers she will be dealing with. Do we meet all the FMLA criteria?

  • With documentation I would say you are on the right track but I would err on the side of caution. Allow her to return to the same position but inform her (and document) that you discovered problems with her job performance and she will be given x amount of time to correct any problems. May not be what she deserves but it will save on your legal fees.
