Can I ask for monthly updates?

There seems to be a FMLA bug going around - at least here in Rhode Island. Can I ask everyone on approved FMLA leave to update us every 30 days with a refreshed doctors note? I have a few questionable folks out on leave who seem to have a new reason to be out again as soon as they're eligible for more leave. Also, with all of our leaves, including FMLA, our employee handbook states that we have the right to ask for refreshed information.

  • FMLA regs state that you have the right to ask for new certifications on a regular basis but not less than 30 days. Just make sure EVERYONE is required to do this and not just certain people.
  • Linda S hits it on the head with the word 'certification'. Be sure you don't just ask for 'updates'. Those will come in the form of a 3x5 piece of paper with the doctor's initials stamped at the bottom and 'cannot return till..' inserted by a clerical employee. What you need is certification so that you can make an intelligent and legal decision regarding the leave's approval.
