Hours vs Weeks

Some of our office staff work 37.5 hours as a standard work week, while others out in the field work 40. I know employees are entitled to 12 weeks of FMLA leave, or 480 hours. How does that work out for the employee whose standard work week is 37.5 hours. 37.5 x 12 weeks only works out to 450 hours. Do they actually get 480 hours, or 12 weeks? Also, do any of you have a good tracking system that they can share?

  • I don't know if I have an accurate answer for you, but this is what I would do in your circumstances.

    If the EE is using intermittent FMLA calculate the hours; otherwise 12 weeks is 12 weeks.

    My tracking consists of a spreadsheet, not very efficient, but it's all I need with only 54 employees.
  • You may figure the time either way, just be consistent. We have some 12 hour positions - 36 one week - 48 the next and also have some that work 30-32 hrs per week. We figure our FMLA entitlement by the hour. I too have a spreadsheet and between my assistant and our payroll dept. we try to stay on top of 360 EEs.
