Revocation of Preliminary Designation for FMLA leave

Does anyone have a sample letter to revoke a preliminary designation. We had an employee come in and from information given, it appeared that he was eligible. We gave him a preliminary designation ltr and medical certification forms. Doctor excused him for 3 days and released him to come back to work and would not fill out certification form. He did not come back to work, but called in sick daily. He went to another doctor, who excused him for 4 days and then released him to come back to work and would not fill certification forms. (He has been out a total of 20 days - of which he has a doctor's excuse for 7 days.) We want to formally revoke his designation.

The employee was never approved for FMLA, only told that his condition may be covered under FMLA pending proper certification. He never produced proper certification so he cannot be approved. If you want to put it in writting just use company letterhead and write a brief paragraph that his FMLA request cannot be approved due to the doctor's certification not being filled out and that all absences are subject to the company attendance policy. Make two copies, one for you and the other for the employee.
