Retro FMLA coverage??

Hello -
Can anyone confirm for me that the FMLA law states that we must cover FMLA related absences 30 back from the date of certification. That is what I have always thought the law stated but can't seem to find it in writing anywhere. Thanks!

  • I'm guessing that your 30 time frame is being confused with many other "30 day requirements" of the Act. There's no such 30 day period as you describe. Think of it this way: The employer can request the medical certification and the employee must provide it within 15 days of the employer's request.

    FMLA does permit retro approval when waiting for the med cert form, but there's nothing that requires you to approve the prior 30 day period.
  • Are you thinking that it is requested an employee give the company a 30 day notice if it is a forseeable leave period? (e.g. pregnancy)
