FMLA for pregnant dependent child

We have an employee whose 16 year old daughter who is due to have her baby shortly. We've received an FMLA request from the employee. Is the employee entitled to FMLA for the daughter's recovery from the delivery? Once the baby is born, does the daughter have a serious health condition?

  • FMLA only covers the birth of a child of the employee and the ensuing "bonding" time up to 12 weeks. This provision also extends to males whose spouses have had children. The couple would be entited up to 12 weeks each unless they both work for the same company in which case they would only be entitled up to a combination of the 12 weeks.

    Unless this is a complicated pregnancy, I doubt very seriously if this would qualify for a 12 weeks FMLA leave. A physician would have to come up with some type of documented medical necessity.
