FMLA Confusion

I have an employee at one of our shops that was out for a month and a half due to a drinking problem. He was given Short Term Disability (STD) and received a paycheck for the time he was out! I am confused because I thought it should have been FML due to the fact he was in a rehab clinic under a physicians care. There is nothing written that shows what specific conditions are covered under FML or STD. I always thought STD was used if you needed surgery or something like that. I am still new to this whole thing and need clarification. Please help.

  • We have processed treatment for alcoholism under our short term disability and it has been approved as a legitimate disability and covered. Is this person out due to the alcoholism's effects, or out for treatment? That could make a big difference. And this is protected by the ADA as well, if I'm correct. Also, if your plan states that a disability runs concurrent with FMLA, it would fall under both then.
