FMLA & Organ Donation

An employee wishes to donate an organ to a family member. Does this qualify as FMLA, since the surgery on the employee will require an extended time off?

  • It sure sounds like a serious medical condition. It would be FMLA unless the law has some exception for elective procedures. And helping the employee will create some warm fuzzy feelings for the company.

Having thoroughly read through the regs numerous times, I don't recall anything about elective surgery being an exception. Just as an employee electing to have a non-malignancy removed from his or her face, for example...this too would qualify for FMLA. Right after giving her the FMLA paperwork, I would be spending my efforts buying balloons and cakes for a pre-surgery office celebration for this employee. Good luck with the party.
