Diabetes & FMLA

We have 5 employees who are diabetic (taking insulin orally or daily injections). I know this because they talk about it to everyone. No one has missed 3 consecutive days due to this medical problem but I'm wondering if I should give them notice that they may be eligible for FMLA protection in the event they should have a problem? Also, could this fall under intermittent leave?

  • I'm assuming these employees know something about FMLA from your policies or new hire orientation, etc....., so I don't think I'd run down the hall to inform these folks of FMLA's potential. This will only become an issue if their health deteriorates to a serious or chronic status and then intermittent leave may apply. Remember, the employee has the responsibility to provide enough information about why they missed work to qualify for FMLA, so with no absences from work, I'd wait until the issue surfaces.
