In the 13 years our company has been in business we have only had to terminate one employee. And he won't go away. His last day withour company was December 14, 2007. He filed for unemployment, we challenged the claim and won. He didn't get unemployment for the 2 months that he worked for us.
Now more than a year after the decision from the CO Dept of Labor we've received another request for information because he's filed for unemployment again. The Request for Information form states there could be a potential charge to our account for the same amount they denied him following his December 2007 termination.
We've never had an employee file for unemployment, can they do this? Can they come back to a previous employer 13 1/2 months later and try to get unemployment if the state has already ruled in the employers favor?

I have had this happen a number of times, and if we have never been charged if we were not charged the first time. Don't worry about it. They are just covering their bases.

This happens to me all the time, Cheryl. I have to track ex-employees on a UI spreadsheet forever, it seems. I've had people pop back up 3 or 4 years after they left us!
