I was looking at the M Lee class on reference checking, and it made me wonder...
Has anyone here ever, first hand, experienced a defamation-type lawsuit stemming from a negative reference check?

Frankly, I don't like it. Any HR person knows how to phrase a reference so that the inquiry provides information without being defamatory.
Oregon law protects employers who make good faith reference statements. I think its always wise to check what you have documented and use considered language when giving a negative reference but I have never understood why employers are so reticent to give factual references.
