Requiring Valid Drivers License

We are a bank with 3 locations. We expect some of our employees to regularly travel among locations for training or troubleshooting. We expect our loan officers to go out to meet with clients and potential clients. Can we require these employees to have a valid drivers license as a condition of employment?

If they are driving a vehicle in the course of company business, then a valid drivers license should be a requirement. We have a couple of maintenance employees who have had their licenses suspended. Not only have we excluded them from driving company vehicles, they are not allowed to drive their personal vehicles on company business.

We also require our ee’s that routinely drive on company business to have a safe driving record. The company that does our criminal background checks also completes the check on their driving history. We make a copy of their driver’s license in order to know the expiration date of same.

Our policy states that they must have "reliable transportation" that will allow them to fulfill all job requirements. I recently terminated an assistant branch manager - one of the reasons was that he refused to renew his drivers license and couldn't respond to issues quickly or effectively via public transportation. We found out afterwards that it was actually yanked for refusal to pay child support.

Yes, and please be sure to include this requirement in the job descriptions and outline the requirement in your personnel policy manual. It is a good idea to check the validity of the licenses from time to time and to include in your manual that anyone required to drive as a condition of employment must advise when the license is suspended.
