Employment Verification

Hi...I was hoping that someone could help me out!!! I just received a letter in the mail from a law firm requesting employment verification for one of our current employee's. I do not know if I can/should complete this. I believe with all the privacy laws that you need a written authorization from the employee to release any information. Not sure if this goes for creditors as well...please help!!! Thanks!!!

Unless I have anauthorization signed by the employee or ex-employee or a subpoena, I do not release any information to anyone other than, yes they are employed here, or no, they are not employed here.

Thanks...do I have to tell them yes or no about the employment without authorization from the employee?

I don't know of any law that says you have to tell them yes or no; that is just our company policy and we do it consistently. Besides, they may have a judgment and want to garnish wages. I'd a lot rather tell them yes and let them get started than have to provide a bunch of unnecessary documentation in response to a supoena.

I do the same as Joannie. With no written authorization from the ee, I will only verify whether or not they are still employed by us. To release any other information, I require written authorization from the ee.

Without written authorization from the employee I will only verify current employment status, date of hire and position. For term'd employees I verify date of hire/termination and position at termination. If the requester wants payroll information or anything other than the above I require a signed release from the employee/ex-employee.

We do verifications like Irie. However, the caller must know the information (dates of employment and position) and then we confirm. We do not offer it.

If I have a written authorization then we will offer dates, position, and wages.
