W.C. and auto accident

One of our ee's was in an auto accident while taking the mail to the post office. She was not injured, but her car sustained a lot of damage. w.C. doesn't cover the car but who does??? It was her car not the company's.

Hello Nigel.
We had almost identical situation except on way to bank. Our insurance guy told us the car insurance follows the car. However, since it was company business, we agreed to pay her deductibles. We did not have to but felt that since she was performing a service for the practice and would not otherwise have gone to the bank at that time, we should assist her.

This just came up today. Team was traveling to an auto show, of two vehicles, one was personal vehicle. Windshield damaged. We paid deductible. It's the right thing to do.

We also have ee's that sometimes use their personal vehicle to take the mail to the Post Office. No accidents, so far. According to our WC carrier, it is the responsibility of their personal auto insurance, same as if they had an accident while driving any other time.

We're fortunate, in that we have a company van that is used for such errands. If an employee wants to use their own car (usually because they can't smoke in the company van) they may do so, but it absolves us of that obligation.

It's in our travel policy that when ee's use their personal vehicles for company business their must use their own insurance for any claims.
