voluntary demotions

Scenario: An employee voluntary accepts a lower-paying position in the same company (voluntary demotion)and this decision is based on the employee's performance problems in the higher paying position. (No discipline or forced demotion is involved.)

Questions:
1. Do you have policy language that addresses what happens to the employee if s/he does not pass a mandatory 6-month probation in the lower position, and if so, what is that language? If not, what is your past practice?

2. Does your policy language or your past practice change if poor performance in the higher paying job was not involved?

  • We have a generic policy that addresses any sort of inter-departmental transfer. Basically, the EE is subject to the same introductory period as a brand new employee. If they don't perform, they are terminated. Also, we do not allow a transfer if the EE is not in good standing, and poor performance would be an example of that.
