Anyone from NJ please chime in. In our state can we ask on our application forms if an applicant has ever been arrested? If so, can we inquire at the interview as to what the charges were and if they were convicted? I don't believe we can. Thanks.

I don't believe this is a state issue. I believe that it is a Title VII issue of disparate impact.

In addition an arrest doesn't mean squat. Many people get arrested and the charges are completely dropped. What you are looking for is convictions. So why not just ask about convictions? I know of no law that prohibits asking about conviction.
