Disability

As a small company (less then 35 employees )we had a new employee who worked for us less then 30 days and went out on disability, during the time that the party has been out (over 30 days)and has not yet returned. The company has decided to eliminate the position and re-structure the department. The employee's performance was an issue, not catching on and the employee went out on disability before the company had a chance to document the performance. I was just wondering what we have to do upon the employees return to avoid a lawsuit? We don't feel the employee would be a fit and would like to release from employment. Any information any one could provide in regards to this would be great!
