WARN Notice

My question is if the number of employees is determined by the facility closing or by the number of employees of the total Corporation to determine if the employer is a company goverened by WARN. Can anyone help?

The couple times it has affected us or could possibly have affected us, we treated each plant as separate entities. But, another posters lawyer said combine all plants to determine the numbers.

You have to consider both. First, determine if the employer has 100 or more employees. This is done by counting the TOTAL number of employees within the company, including in that calculation all facilcites and plant locations. The next threshold is to determine if the particular facility that is going to close/mass layoff has 50 or more employees that would be effected by the layoff/closure.

After some more research, I have come to the same conclusion. The total number of employees of the entire Corporation determines the number to be over 100 and the shutdown would involve more than 50, so the notice is required.
