Not rehiring lay off individuals

The hiring season is coming up for this company and there were employees laid off during the slower work season. Is a non-union company in the State of Texas required to call back lay off individuals before hiring new employees? The work requirements have not changed.

I can't speak for TX, but I don't normally rehire those laid off since they tend to be poor performers or attendance problems. But, when we lay them off, we tell them it is permanent with no guarantee of recall as opposed to a temporary layoff.
