Update on Terminating IT /Security Manager

I had a call 7:00 am last Thursday morning. The IT Manager hurt his back the night before "moving a desk to look at wires to fix a computer so his boss wouldn't fire him". A direct quote from the employee.

There was a reliable witness who heard the IT's back pop. He has had back problems in the past.

We now have the extra considerations of Workers Comp and FMLA. Since it appears that he may be out for a while we are going to have to take a look at all the systems. It will be interesting to see what we find; it will all be documented.

    I didn’t provide anything on your first post, cause you were getting excellent info from everyone else. A couple of thoughts did occur to me with this update from you. Depending on how your system is set up, your IT mgr could have been reading everyone’s email and knew he was to be termed. Sometimes it’s better to have these kind of discussions off line. The injury may be coincidental or planned (you can fake a pop) but as you mentioned you now have other considerations before doing the term. As Evergreen posted, make sure you get a very experienced company that has handled these kind of IT situations. There could be backdoors, embedded viruses, data and correspondence deleted or even fake ones created. EE may have saved every file you or the CEO created and Web site visited, plus have all EEs’ personal HR info. If you have personal customer base info, like SSN that is released, then you may have notification requirements. Not trying to scare you but you had expressed concern for your personal safety. I think most people resort to the area of their skill first. If your IT consultant finds any kinds of inappropriate hardware or software alterations or additions that can be documented it can go a long way helping a good emp law attorney defend you. Best of luck and hopefully this will not be as serious an event as it could be. Keep us posted.
