online job referrals

We just started using Jobdango to post job openings. I was VERY surprised to see that they ask for citizenship status (choices are other, US citizen, US Permanent Resident, or unspecified), ethnicity (with 9 choices plus other and unspecified) and gender (male, female, unspecified) on their resume screen. You can pull your resume to a job listing and not have to enter all the information if the company has their own job application attached.
My concern: What is our legal liability in having that information as part of their application? Normally we wouldn't solicit it until they have been offered a job and accepted.
Has anyone else ran into this type of situation?
