Final Paycheck

If you terminate an employee and as part of his employment agreement he agrees to pay back 50% of any schooling we paid for; is it okay to take it from his final paycheck; and does it matter if you take it from his wages or his commission?

That will probably depend on the state law in your state. If you are in Ca., no.

ONly deduct from a paycheck when you have specific, signed authorization from the EE. Just the agreement to repay is not enough, it must state the repayment is authorized as a paycheck deduction.

BETHHR: What does your company policy say? Ours would direct me to have it in written format as an approved Accounts payable item. As a matter of priority, I would take it from any commission first and then his wages 2nd.
