meal and break periods required?

I have read the meal period guidelines on the dol for NYS. It is not clear to me on breaks and meal requirements for a full service gas station. If a pumper has a shift starting at 2 pm and runs until 9 - 9:30 pm what are the required breaks if any?

The Fair Labor Standards Act does not require breaks. I do not know what your state statutes might require.

Just curious, misklu, why you can't apply the guidelines you've got from the NYS DOL. Why would a full service gas station earn an exemption from said guidelines?

Mercantile and other ees, who work a shift of 6 or more hours between the hours of 1 p.m. and 6 a.m. must be provided a meal break of least 45 minutes midway between the start and end of the shift. (other categories are factory workers, surface and elevated railroad ees and minors aged 17 or younger.)
