Return of Company Property

In Florida, can criminal charges be brought against an employee who refused to return company property which includes customer documents and information? I know we can get a civil injunction, but I was wondering about doing something criminally-like theft.

How good is your documentation?

I only ask because I think you could ask the DA to press charges, but be prepared to produce evidence that the information you seek is owned by the company and that the EE had a duty to return, and that the EE refused.

JSCHEIDTER: I am not in Florida, but I have sworn out for arrest employees who have been caught with the pawning of company property! I would think, if you have documentation to defend your company from reverse charges of "wrongful arrest" or "slander" and these types of charges, you should be in the right to use the judicial system like the bad attitude employee does.
