Generally, it is against the law. Take a look at your required poster up front. See "Polygraph Protection Act". There are very, very few situations in which an employer can polygraph. Also see: "Attorney, Labor Law" in the yellow pages.
The law permits employees of private sector who are reasonably suspected of involvement in a violation (such as theft) to be tested with notice; however suspectees are given certain rights including the right to refuse to be tested. There's more to it. If you think you want to proceed, check with your legal counsel.
If I'm not mistaken, it is also true that even in those rare situations where testing might be upheld, the results are not admissable in court. As a free sidenote, does anyone remember who sponsored this legislation some years ago and will you be surprised to learn that it was Edward Kennedy?
