No Weingarten Rights for non-union ees

Guess what? The NLRB has changed their mind again; in IBM Corp., 341 NLRB No. 148, they have ruled that non-union employees don't have
Weingarten rights in investigatory meetings.

So if an employer has union AND non-union employees does the employer still have to give the non-union ee's the same rights because the workforce is union or does this preclude them now?

Different rules for different groups. Weingarten applies to the union folks, it doesn't apply to the non-union.

Of course, implicit in all of this is that the NLRB could change their mind again at any time, and you could be the case that makes the new rules.
