Does federal funding require drug testing

We receive federal funds and I cannot find anywhere in the contracts or other information if we are required by virtue of the fact that we receive federal funds to drug test our employees?
Anyone know anything about this?

  • My understanding of it is employers who receive above a specific threshold amount of revenue from military or government contracts, are required to have a drug program per the Drug Free Workplace Act of 1988. That would be a starting point for you - research that act to see if our employer qualifies. The act does not specify drug testing, it just says you must have a program to ensure a drug-free workplace.
  • The SHRM learning materials I used to prepare for the SPHR 3 years ago say that federal contractors with contracts of $100,000 or more must follow certain requirements to certify they are maintaining a drug-free workplace.

Do a search on Drug-Free Workplace Act, 1988 or send me a fax number and I'll copy and fax this page to you.
