Final Paycheck held

Do any of you have any language that you have used when you go to exchange a final paycheck for work property?

We terminated an employee and withheld his final check until he returned the company's property. I will be exchangint eh check for the property this week and wonder if I should have him sign something acknowledging the return of tribal property.

More than likely it's illegal to do what you're doing unless there is a signed agreement to that effect. But, I notice you mention tribal property and if you're an employer on an Indian Reservation you may fall under tribal laws.

I agree with Don. Check your tribal laws - what you intend to do would be illegal under Washington state law.

That would not work under Nevada State laws either. You could have an agreement signed when the property is checked out that they will return same in good condition or agree to a payroll deduction of a stated amount. The deductions cannot result in pay below minimum wage. But as Don and Parabeagle said, tribal laws may give you more lattitude than state law.
