Military Federal Statute - Effect on termination

Has anyone terminated anyone who was on active duty for somethign they did prior to going on to sea? In other words, the termination is for cause, it just happened that the invetigation didn't end till after the individual was already out to see, a reservist.

Check out the website esgr.org. This is the Employer Support for the Guard and Reserve organization and they should have the most current USERRA information. Common sense would tell me that if it was for cause and you would have terminated regardless of his reserve status you should be OK to terminate. But where the law is concerned nothing is simple so I would check the website and consult with your lawyer.
