we are contemplating allowing individuals to post their job applications by email. we need a "signature" to check on background references. does the E-SIGN ACT apply? were you able to meet the requirements in house or did you have to employ a company( if so, any referrals?) thanks.

Why would you want to do that? Would this background check be done before the first interview? Seems to me that you are putting the cart in front of the horse.

Because of the expense, we do not background check until we are ready to make an offer. Even then, we offer employment contingent upon receiving satisfactory results. During my 4 years hear (2 in HR), only one person has been let go because of the check.
