Applicant No Show, Claims ESC payment

Has anyone had a situation like this?
We advertised with the local ESC for Sewers and several submited and showed for an interveiw. We phoned one of the appliants to return to complete the paper work so that we may offer employment. The other candidates received letters saying "thanks, but no thanks".
We mailed the paper work back to ESC stating we are offering the position to the applicant.
The applicant never showed to filled out the required paper work.
Since than, the ESC filed stating that the applicant stated that they lived to far (we asked the applicant if distance or transportation was a problem- no problem) and that pay rate was not enough.
Also, during the phone hearing with ESC, we learned that applicant reported different wages to ESC and to us.
We don't believe that we should be penalized by the ESC, since applicant never worked for us and gave us incorrect wage rates.
It seems that by reorting that we would offer applicant a position we are penalized.
Your advise would be appreciated.

I do not understand your post. They were awarded UI for a job they never took? I thought you had to be employed for a certain amount of time before you were eligible for UI.

Were they collecting UI from another job and thats how they were referred to you?

ESC in NC is the Employment Security Commission. They determine if ee gets UI among other things.

Maybe I'm misreading this, but it sounds to me like this ESC is either a "headhunter" or other type of employment office. They must have a contract or some type of rating system they use if and when an employer offers a position to someone sent by this organization/company. Just my take on the post.

ESC is the state Employment Security Commission. The post is a bit confusing. Nobody is awarded UI following a job referral, no matter whether they accept the job or decline it or don't show up for it. The exchange you had with the ESC staffer does not make sense to me. Sounds like you called to report that you had hired their referral. They told you the person declined the job because of the wages and distance. You countered that the information the applicant provided them was wrong. End of conversation. Your account is unaffected. Forget the ESC.

In GA they have work programs at the UI offices. If you post a job with them, they will screen and send you candidates. I guess the ESC is the same??

Best if you could clarify your situation for us, I think we are all a little confused.

Are you stating that this employee was offered the job, but didn't accept it and filed for UI against your company because.... because of I don't know what.

Applicant was to complete paper work and we returned ESC form stating we found an applicant. Applicant did not show up for work. But, since we returned form -made an offer according to ESC - we pay.

Ortho: I will bet you twenty dollars and my felt fedora that the applicant/claimant will not draw benefits on the scenario you rolled out. The system does not work that way. Since I worked in that system for some years I will provide some explanation. Employment Security Commissions consist of several departments. Two of those are unemployment insurance and employment service (Job Service or whatever this year's trendy name is). One takes claims, the other registers people for work and is supposed to match workers with jobs. Perhaps he was a claimant and required to register for work and was referred by the sister side of the office. When they are referred, they take a referral card with them. Employers are not obligated to, but sometimes will return the referral card indicating the outcome of the interview and whether or not hired. The card also gives you an opportunity to check (not hired), (job filled), etc. That's the end of the dance as far as the employer is concerned. Nobody's UI account is affected by either of the employer's responses. If you heard otherwise from the claims office, ask to speak with a supervising interviewer. If she says the same, tell me where to mail your fedora.
