Applicant No Show, Claims ESC payment

Has anyone had a situation like this?
We advertised with the local ESC for Sewers and several submited and showed for an interveiw. We phoned one of the appliants to return to complete the paper work so that we may offer employment. The other candidates received letters saying "thanks, but no thanks".
We mailed the paper work back to ESC stating we are offering the position to the applicant.
The applicant never showed to filled out the required paper work.
Since than, the ESC filed stating that the applicant stated that they lived to far (we asked the applicant if distance or transportation was a problem- no problem) and that pay rate was not enough.
Also, during the phone hearing with ESC, we learned that applicant reported different wages to ESC and to us.
We don't believe that we should be penalized by the ESC, since applicant never worked for us and gave us incorrect wage rates.
It seems that by reorting that we would offer applicant a position we are penalized.
Your advise would be appreciated.
