If you have a fully-funded insurance plan and all you do is enroll/terminate employees and get no more than summary information from the health care provider, then you do not have to be HIPAA compliant. HIPAA is relevant to self-funded plans when you are administering claims and privy to more than just summary information.

I contacted the Department of Health and Human Services (866-627-7748) and they were very helpful with the questions I had. Or you can check out the website for the Department of Health and Human Services.

Boy that's good news. Thanks for the advice and referral. From the information above I'm assuming the questions asked on the application about medical are not considered protection information?

Medical screening went away with the first part of HIPAA back in 1997 for group health insurance. Are you enrolling people in individual health insurance?

No it's group coverage. Not medical screening - just questions on the enrollment forms that are asked.

Has anyone figured out how to handle medical FSAs? I am told they are considered self-funded which puts them into the most stringent compliance categories. We have a FSA and it is outsourced. We receive absolutely no PHI and yet, the best I can figure out, we have to go ahead the write an exhaustive policy, provide notifications, train, etc. Is there something I am missing? It is insane.

Domer - In my past discussion with our attorney he did advise that if you have an FSA plan you fall under the ruling for HIPAA compliance.

Both have good info for you if you are a small business. We are a county gov't, self-funded, under $5mill in receipts and I have used both sources extensively.
