FCRA

We currently provide the summary of rights to applicants who are not hired due to a background check issue. A question has come up whether just posting the Summary of Rights in the reception area would still maintain compliance of this regulation or whether it is a requirement that this summary of rights be given to the individual.

  • If solely based on credit info, the FCRA states, "Before taking any adverse action, the employer must provide the applicant/employee with a copy of the consumer report, notification that the employer is considering taking adverse action based on the report, and a detailed summary of the individual's rights under the FCRA." To be on the safe side, I would say that a posting is not enough.
