Excessive Absenteeism

Our company provides 10 days vacation and 5 personal days per year. I have 2 employees who have excessive absenteeism and have far exceeded the 15 days. In Texas, can I dock pay for days off exceeding the 15?

  • Are they exempt? If so, you can deduct in full day increments if you have a bona fied time off policy in place. The problem with that is that if they normally work weekends, long hours, take work home, etc. and you start deducting from their pay, they may not put in as much effort in the future. Is the job getting done? You may have more of a performance problem than an attendance problem.
