Verbal Resignation - Help!

We have an employee, who in a moment of frustration, said "ok, if you want me out of here, you have my 2-week notice." The employee regrets his verbal resignation and wants to stay with us.

We would prefer to accept the verbal resignation. Is there any problem with this? Thanks for your help!

How many witnesses were there? At any rate just document the conversation and say "see ya"

Just to be safe, I would want handy documentation showing the date and time of his verbal resignation and the names of any witnesses to the statement - just for my comfort level. But assuming you are an at-will employer, no union issues, etc. I don't see any reason not to accept his verbal resignation.

Document, and let them know you have accepted it. If there were witnesses, well then today is your lucky day!

Is this employee one valuable enough to the company to keep him/her ? If so, fine. If not - say goodbye.

Did the EE retract the resignation before you accepted it? If so, you may have a small issue, but if you want them gone, accept the resignation, document the original conversation and be ready to fight the UI claim.

Nope, we have had this happen before and wish them on their merry way.

I have had this happen before and, in my situation, it was a good employee who was "quitting" because of some harassment issues. I told her to think about it overnight and come back to me in the morning. She did and we were able to effectively address the harassment issues with the other employee and she is still with us.

What it boils down to is whether or not you want the person to continue working for your company and, in absence of some potential harassment/discrimination issues, if you want to accept the resignation you have the right to do so.
