Would this be a HIPAA violation?

When we have employees out on medical leave there are other employees who get together and collect "donations" for the ill employee. They put notices on the bulletin boards in the plant stating "XXX is off work due to ________. We are taking a collection for him/her and if you are interested in donating, contact XXX". Due to our size we do not have to be in compliance with HIPAA until next year but wanted to know if the rest of you feel this would be a violation. One last thing, we are a union shop so many of these things are organized by the union committee.

  • I don't see a problem if the blank line is filled in with the word 'illness' and not a full blown description of the medical issues, complications, prognosis, etc. It would not be a violation, either, for the Union, on its own initiative, and hopefully on its letterhead, to do what they are doing.
  • Actually, the notice would read something like, "XX is off work due to knee surgery" so it gets pretty specific. As far as the letterhead, they are not on the union letterhead and the notices are placed on ALL the bulletin boards, not just the unions.
