On the application form, are we within our legal rights to ask if the applicant has ever filed a workmen's compensation claim? We have always been instructed that it is illegal to do. However, one of our employees told us that on an application form her husband recently submitted, the company included this question on their applicaton form.

It is illegal. I have a post offer medical questionairre that asks about WC claims, but again it is post-offer. It also has all that great disclaimer language. Only thing I can use the information for is if they omit or falsify information that is uncovered on the wc background check. Then I can rescind my offer.
